The sale of HORUS VISION, LLC products are expressly conditioned upon the purchaser's acceptance of the following terms:
Precautions
This Product is intended for use with firearms. Firearms can be dangerous. A mistake in judgment, a lapse of attention, a malfunction of any kind can result in serious injury or death. Bad things sometimes happen to good people. Please be careful when you use firearms. The information and/or software which accompanies the Product, while believed to be reasonably accurate as of the date of publication, is not warranted or represented to be accurate, correct, or useful for any particular purpose. Use the information provided with the Product with caution and common sense, and verify the information with respect to your own firearms before use. HORUS VISION, LLC and the author and publisher are not responsible for errors in the information provided, or for accidents, injuries, damage, or any other problems which might arise as a result of your use of the information provided, and expressly disclaim all liability for injuries, death, and damages, as set forth below.
Software Limited License
HORUS VISION, LLC. hereby grants to the purchaser a non-exclusive license to use any SOFTWARE furnished with the Product. The purchaser may not copy the SOFTWARE except for back-up purposes. The purchaser acknowledges that the SOFTWARE and all proprietary and intellectual property rights arising therefrom, remain the sole and exclusive property of HORUS VISION, LLC. Purchaser shall not disclose, publish, sell, assign, lease, sublicense, market or transfer the SOFTWARE (or any version or portion thereof) except as a part of a transfer of the Product. Purchaser shall not alter, modify, translate, decompile, disassemble, reverse engineer or create derivative works of the SOFTWARE or any part thereof. HORUS VISION, LLC. reserves all rights to the SOFTWARE not expressly granted to the purchaser.
Export Restrictions
This Product may be subject to Federal Export Restrictions. Purchaser shall not export the Product or any accompanying SOFTWARE unless in compliance with federal regulations in effect at the time of export.
Warranty and Disclaimer of all Other Warranties
1. HORUS VISION, LLC warrants this product against defects in workmanship or materials for a period of one (1) year after the date of the original retail purchase. During this warranty period, HORUS VISION, LLC will repair or replace, at its option, a defective product or part without charge to you. You will be responsible for transportation charges, if any, for delivering the product to and from HORUS VISION, LLC. This warranty extends only to defects in workmanship, and does not extend to damage to products or parts which result from alteration, repair, modification, faulty installation, or damage caused by accident, abuse, misuse, maintenance, mishandling, misapplication, or use in violation of the instructions furnished by HORUS VISION, LLC.
2. Any repaired or replacement parts furnished in fulfillment of this warranty are warranted only for the unexpired portion of the original warranty.
3. To obtain warranty service, ship the product postpaid and fully insured to HORUS VISION, LLC., 659 Huntington Ave., San Bruno, California 94066, togther with a copy of your bill of sale, your name and address, and a description of the problem. All products returned for warranty service must be carefully packed in the original packing materials.
4. HORUS VISION, LLC EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE, DESIGN, CONDITION, QUALITY, CAPACITY, MATERIAL OR WORKMANSHIP. ALL WARRANTIES REQUIRED TO BE IMPLIED BY STATE LAW ARE EXPRESSLY LIMITED TO THE DURATION OF THE LIMITED WARRANTIES SET FORTH ABOVE. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. WITH THE EXCEPTION OF ANY WARRANTIES REQUIRED TO BE IMPLIED BY STATE LAW AS HEREBY LIMITED, THE FOREGOING EXPRESS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES.
5. IN NO EVENT SHALL HORUS VISION, LLC BE LIABLE FOR SPECIAL, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGE TO PROPERTY OR INJURIES OR DEATH TO PERSONS CAUSED BY THIS PRODUCT OR THE INFORMATION FURNISHED THEREWITH, INCONVENIENCE, LOSS OF USE OF THIS PRODUCT OR ANY ASSOCIATED EQUIPMENT, COST OF SUBSTITUTE EQUIPMENT, DOWNTIME COSTS, OR CLAIMS OF ANY PARTY DEALING WITH THE PURCHASER FOR SUCH DAMAGES RESULTING FROM THE USE OF THIS PRODUCT OR ARISING FROM BREACH OR WARRANTY OR CONTRACT, NEGLIGENCE OR OTHER LEGAL THEORY, EVEN IF HORUS VISION, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE PRODUCT REMAINS WITH THE PURCHASER AND HORUS VISION, LLC SHALL NOT BE RESPONSIBLE FOR DAMAGES OF ANY KIND RELATED THERETO EXCEPT AS EXPRESSLY SET FORTH IN THE LIMITED WARRANTY ABOVE. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
